U.S.- China hearing on Enforcement of Intellectual Property Rights

The U.S.-China Economic and Security Review Commission will conduct a public hearing on Wednesday, June 7, 2006 and Thursday, June 8, 2006 on China’s Enforcement of Intellectual Property Rights; and the Dangers of the Movement of Counterfeited and Pirated Goods into the United States. The hearing will be held in Room 385 Russell Senate Office Building, Delaware & Constitution Avenues, NE, Washington, DC 20510

The hearing will assess China’s compliance with the provisions of its World Trade Organization accession agreement that address intellectual property rights, and will examine how China’s policies are affecting U.S. national security, and the entertainment, recording, pharmaceutical, and automotive industries. It also will seek information about actions the U.S. government can take to improve the current level of intellectual property rights protection.

The Commission will hear from members of Congress, Deputy Assistant Secretary of Commerce for Technology Policy Chris Israel, Assistant U.S. Trade Representative for China Affairs Timothy Stratford, and Randall Lutter, Associate Commissioner of the Federal Drug Administration for Policy and Planning. The Commission also will hear from industry representatives and academic and legal experts to fill out their knowledge of how intellectual property rights infringement in China affects U.S. industries and what the U.S. government can do to protect U.S. interests.

Definition:
Information that enables a person to accomplish a particular task or to operate a particular device or process.

Compilation

Definition:
A copyrightable work consisting of a collection and assembly of preexisting material.

Novelty and prior art

Definition:
A trade secret may be a device or process which is patentable; but it need not be that. It may be a device or process which is clearly anticipated in the prior art or one which is merely a mechanical improvement that a good mechanic can make. Novelty and invention are not requisite for a trade secret as they are for patentability. These requirements are essential to patentability because a patent protects against unlicensed use of the patented device or process even by one who discovers it properly through independent research.
